1. General
- When an order is placed in the webshop, a purchase contract is concluded between the end customer and DIgSILENT GmbH.
- The software licences provided as part of the training may not be used commercially.
- The provided training documents (PDF and PFD files) can be passed on and duplicated for internal purposes. It is forbidden to pass on or publish the documents outside the company.
- The videos made available as part of the Self E-Learning courses may not be downloaded (for example by using third-party software).
- The access to an Self E-Learning course is personal and may not be passed on.
- Training courses can only be booked by companies in the webshop. Private individuals can request an offer for the courses by emailing to training@digsilent.de.
- Incorrect information, such as the indication of false or expired maintenance contracts, may lead to additional claims in individual cases.
2. Terms of Payment
- Prices quoted in the webshop are exclusive of VAT.
- The applicable sales tax is automatically added in the checkout area depending on the country of invoice.
- If the payment method “Pay by invoice” is selected, the invoice amount must be transferred to the account on the invoice indicating our invoice number within 30 days.
- If the payment method “credit card” is selected, the invoice amount is due immediately upon conclusion of the contract. The credit card payment method is processed in cooperation with BS PAYONE GmbH, Lyoner Str. 9, 60528 Frankfurt/Main, Germany, which the seller authorises to collect receivables on his behalf. BS PAYONE GmbH collects the invoice amount from the customer’s specified credit card account. The credit card is debited immediately after the customer’s order has been sent in the webshop. The seller remains responsible for general customer enquiries even if the payment method of credit card payment via BS PAYONE GmbH is selected.
3. Delivery
Onsite Training
All materials and equipment required to take part in a Onsite Training are made available at the training venue.
Online Training
One week before the first day of an Online Training, the necessary files such as the training material, exercise projects and licence keys will be sent to the course participant by e-mail. The e-mail address specified in the order will be used for this purpose, unless additional information on different participant e-mail addresses was provided during the ordering process.
Self E-Learning
Immediately after ordering a Self E-Learning course, the customer is provided with access to our learning management system (LMS) and all booked courses are activated for the duration specified in the respective product.
4. Shipping
Only digital content is required for participation in training courses. These are sent exclusively by e-mail, as described in section “3. Delivery”.
5. Right of Withdrawal
Onsite / Online Training
Onsite / Online Trainings can be cancelled by the participant by sending a mail to training@digsilent.de. Depending on the time remaining until the training, cancellation costs will be incurred, which are listed below.
- Up to 4 weeks before the course: at no cost
- Up to 2 weeks before the course: 50% of the course fee
- Less than 2 weeks before the course: 100% of the course fee
DIgSILENT GmbH reserves the right to cancel a course due to insufficient participants up to 4 weeks before the beginning of the course. In the event that an already confirmed course needs to be cancelled due to force majeure (e.g. due to illness of the trainer), participants will be informed as soon as possible and course fees already paid will be reimbursed. Further claims are excluded, unless the cancellation of the course is due to gross negligence on the part of DIgSILENT GmbH.
Self E-Learning
By ordering a Self E-Learning course, you agree that the execution of the contract for the digital content will begin before the cancellation period expires. By ordering a Self E-Learning course, you also acknowledge that you lose your right of cancellation when the execution of the contract begins.
As Self E-Learning courses are made available immediately after the order process has been completed, there is no right of cancellation for these.
6. Consumer arbitration
Alternative Dispute Resolution in accordance with Art. 14 (1) ODR-VO and § 36 VSBG:
The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
7. Final Provisions
Should any provision of these General Terms and Conditions be invalid, this shall not affect the validity of the other agreements.
